Mechanic Marketplace Terms

The short version

  • You are an independent business. Trackara sends you leads; it does not employ, supervise or insure you.
  • Every job you take is your agreement with your customer: your quote, your work, your warranty, your payment.
  • You are responsible for any licenses, registrations and insurance the law requires for the work you accept.
  • Use customer details only for the job they asked for, and never resell them.
  • Leads are free while we launch, with no promise of how many you get.

What these terms cover

These terms apply to mechanics and shops ("you") who publish a marketplace profile on Trackara Find, operated by Commoner Apps LLC ("Trackara"). They add to your Trackara Pro terms. You accept them when you tick the agreement box and submit your marketplace profile, and they apply to anyone on your account who accepts leads.

Independent business

You are an independent business, not an employee, agent, partner, franchisee or joint venturer of Trackara. You decide which leads to accept, what to charge, when and how to do the work, and what tools, parts and helpers to use. You pay your own taxes, expenses and people. You may not say or suggest that Trackara employs you, endorses your work, or guarantees it.

Licenses, insurance and compliance

You are solely responsible for holding and keeping current any business, repair, emissions, RV or other licenses, registrations, permits and insurance the law requires where you work, and for following all laws that apply to your work, including consumer protection, auto repair, estimate and invoice, environmental and disposal, and warranty laws. Only accept work you are qualified, licensed and equipped to do safely.

Insurance is not required to join Trackara Find. If you give us a certificate of insurance, we may check it and show an Insured badge until the policy's expiry date. You must tell us if the policy is cancelled or changes, and the badge is removed when it lapses.

Your profile

Keep your profile accurate and current: your business name, contact details, service area, services, vehicle types, credentials and photos. Don't list credentials, insurance or experience you don't have. You give Trackara permission to show your profile, photo, logo, ratings and reviews on Trackara Find and in search results and to customers.

Leads

Trackara offers you requests that match your profile, a few mechanics at a time. Leads are free during our launch; we will give you at least 30 days' notice in writing before charging for them, and you can leave before any charge starts. Trackara does not promise any number or quality of leads, that any customer will hire you, or that a customer's description is accurate. Accept only leads you intend to contact promptly; the customer is told a mechanic is on the way to getting in touch.

Your agreement with the customer

When you accept a lead, any job that follows is a contract between you and the customer alone. You are responsible for it, including:

  • Contacting the customer promptly, and quoting the price before starting work. Give the quote and any change to it in writing (a text or email counts), and follow any estimate rules in your state.
  • Doing the work competently and safely, and standing behind it with the warranty you tell the customer about.
  • Taking payment directly from the customer. Trackara does not collect, hold or guarantee payment, and is not responsible for unpaid invoices, chargebacks or refunds.
  • Handling complaints, damage, warranty claims and disputes with the customer, and carrying whatever insurance you need for them.
  • Following the customer's warranty, service contract or insurer rules when the request says one is involved, including getting their approval before work when required.
  • Marking the job complete in Trackara when it is done, so the customer can review it.

Customer information

Customer names, phone numbers, emails and addresses are shared with you only to respond to and complete that request. Don't sell, share or use them for anything else, including unrelated marketing, unless the customer agrees separately. Keep them secure, and follow the privacy and texting laws that apply to you (for example, get consent before adding a customer to marketing texts or emails).

Conduct and safety

Treat customers honestly and respectfully. No bait pricing, pressure tactics, unnecessary work, discrimination or harassment. Work only where the customer is allowed to have work done, and leave the site clean. Don't arrange to take customers off Trackara to avoid reviews while using Trackara leads. Trackara may pass along complaints to you and ask for your side.

Reviews

Customers whose job was completed through Trackara may review you, and reviews are shown with your profile. You may not write, buy or pressure anyone into reviews of yourself or others, or offer something in exchange for changing or removing a review. You can report a review you believe breaks the rules; we do not remove reviews just for being negative.

Review, suspension and removal

A person at Trackara reviews your business details before your profile goes live. That review is for our own purposes; it is not a license, certification or endorsement, and Trackara does not verify licenses or insurance for you. Trackara may decline, pause or remove a profile, remove a badge, or stop sending leads at any time, including after complaints, no-contact reports or a lapsed certificate. You can pause or unpublish your profile yourself at any time.

Disclaimers and limit on liability

Trackara Find is provided "as is". To the extent the law allows, Trackara disclaims all warranties about the service, the leads and the customers, and is not liable for any indirect, incidental or consequential loss, lost profits, or anything a customer does or fails to do. Trackara's total liability to you for any claim about Trackara Find is limited to the greater of $100 or what you paid Trackara for leads in the 12 months before the claim.

Indemnity

You will defend and hold Trackara harmless from claims, losses and costs (including reasonable attorney fees) that arise from your work, your agreements with customers, your breach of these terms, your use of customer information, or your violation of any law or anyone's rights.

Changes and contact

We may update these terms and will change the date above and tell you in Trackara Pro when we make a material change; if you keep accepting leads after that, the new terms apply. Questions: support@trackara.app, Commoner Apps LLC.
